The fine print, minus the fine print

Terms of Service

The ground rules for working together. Clear, fair, and written like a human wrote them — because one did.

1. The Basics

By using our website (boostbc.ca) or working with us on any of our services, you agree to these Terms of Service. We've written them in plain language because that's how we do everything.

  • Web & Mobile Apps
  • Custom Software
  • Client Studio

The specifics of each engagement — scope, timeline, deliverables — are set out in your individual proposal, quote, or service agreement.

3. Your Side of the Deal

When you work with us, you agree to:

  • Give us accurate info — contact details, business information, and project requirements that are current and complete.
  • Follow the law — use our services in compliance with BC and Canadian laws.
  • Respect our work — don't reuse our content, designs, or code without permission.
  • Play fair — no hacking, disrupting, or interfering with our site or services.
  • Stay responsive — reply to requests for feedback or materials so we can keep your project moving.

4. Payments

  • Pricing: Set out in your proposal or agreement. All prices are in Canadian Dollars (CAD) plus applicable taxes.
  • Project work: Deposits, milestones, and final payments are specified in your contract.
  • Ongoing services (IT support, marketing retainers, content plans): invoiced monthly, due within 15 days.
  • Late payments: May incur late fees or interest, and we may pause services on overdue accounts.
  • Refunds: Deposits and payments for completed work are generally non-refundable. Refund requests are reviewed case-by-case in writing.

5. Who Owns What

  • Your deliverables: Once your project is paid in full, you own the final deliverables — your website, designs, photos, videos, software — as outlined in your agreement. That's a core part of how we work: you own your stuff.
  • Our portfolio rights: We may showcase the work in our portfolio and marketing unless you ask us not to in writing.
  • Our tools: Pre-existing frameworks, code libraries, and templates we use remain ours or their respective owners'.
  • Materials you provide: You're responsible for having the rights to any logos, images, or content you give us, and you'll cover us if a third party claims otherwise.

6. Confidentiality

Both sides agree to keep confidential any sensitive information shared while working together — business strategies, financials, unpublished designs and code, and client data. This doesn't cover information that's already public or independently developed.

7. Liability & Guarantees

  • We work hard, but no magic promises: We can't guarantee specific outcomes like traffic numbers, sales increases, search rankings, or follower growth — too many factors are outside anyone's control.
  • Skill and care: We do warrant that our services will be performed with reasonable skill and care, consistent with industry standards.
  • Liability cap: Our total liability for any claim won't exceed what you paid for the specific service involved.
  • No indirect damages: We're not liable for indirect, incidental, or consequential damages such as lost profits.
  • Exceptions: These limits don't apply to gross negligence, willful misconduct, or breach of confidentiality.

8. Ending Things

  • You can leave anytime with written notice — no long-term lock-ins. You pay for work completed up to that date, and that's it.
  • We may end services if payments stop, these terms are breached, or the relationship isn't workable.
  • After termination: You pay for services rendered; any licenses to BoostBC materials may end unless we agree otherwise.

9. Disputes & Governing Law

These terms are governed by the laws of British Columbia and applicable federal laws of Canada, with disputes handled in the courts of Kelowna, BC.

But honestly — talk to us first. Most issues get sorted with a conversation:

  1. Reach out — most problems are solved with open communication.
  2. Mediation — if that fails, both parties agree to try mediation before legal action.
  3. Arbitration or court — as a last resort, in British Columbia.

10. Housekeeping

  • Updates: We may update these terms from time to time — we'll change the "Last Updated" date when we do. Continuing to use our services means you accept the updates.
  • Severability: If one part of these terms is found unenforceable, the rest still stands.
  • Entire agreement: These terms plus your individual service agreement make up the full deal between us.

Questions? Just ask.

If anything here is unclear, reach out — we're real people in Kelowna, BC, and we answer our own emails.
